((2001)) prisoner of the war on drugs 135 months count 1- conspiracy to manufacture methamphetamine count 2-possession of listed chemical count 3-possession of a gun count 4- not having gun registered i was convicted of these four counts in December 1991. i was a minimal participant but because of the war on drugs, the conspiracy law and the mandatory minimums, i was sentenced to 32 ½ years. When you are charged with conspiracy it takes very little evidence from the courts to get a conviction. As little as someone who is trying to get there sentence reduced to say, “Yes, she knew what was going on.” This law has completely changed my life: because of something my boyfriend was doing I’m caught in a nightmare. I gave him a ride somewhere and ended up in a police procedure called “reverse sting operation.” It did not matter if I knew what was going on or not. The way I was charged reads, “Because I was there, under Pinkerton she’s guilty of everything her boyfriend has done.” (Pinkerton is case law that holds someone guilty because of someone else’s action.) The only 2 people my boyfriend was in conspiracy with, was a Houston narcotics officer and the paid informant. The law reads, “It takes two or more in an agreement to have a conspiracy but it can’t be a paid informant or an officer of the law.” So they needed someone else to convict him, so I was charged with everything. I was convicted of an agreement that I never entered into, a gun I never used, and charged with 14.96 kilos of meth that never existed because under the conspiracy law they took the chemical that the police officer bought to sell and converted it into drugs. Even though no meth was produced from this chemical, government chemist calculated how much it could have made and I was charged with the hypothetical amount. They calculated it at 19.96 kilos of meth and that amount was used to raise my base level to 40,witch at this level doles out sentences such as mine of 32 ½ years all the way up to life. This law has affected so many low level and minimal participant people and their families. I have 2 children that are growing up without me. I haven’t seen them or my family in almost nine years the law truly needs to be recognized for what it is. The public does not really realize the sentencing techniques used for sending so many non-violent drug offenders to prison for such lengthy sentences. I’m telling you from fist hand experience. It doesn’t take much to get 10 years to a life sentence in federal system. All that is needed in a conspiracy charge is as little as giving someone a ride somewhere or using a friends phone to make a case under federal law. “we are doing decades in her wile murders, child molesters, and other violent crimes are doing the average of three to seven years. I ask you, have you really looked at the way your country’s judicial system is being run? I was 28 years old when I came to prison and with good time (54 good days a year) I’ll be 58 years old when I get out. How will I survive then- still off taxpayers? I’ve done more time for my part in the crime, but I’m still looking at 21 more years. It’s like a hole in my soul with a cold winter wind blowing through it……

I talked to Billie Marie yesterday. She called me for Mothers Day. It is so wonderful to even hear her voice. I pray every day that these people who have the say on who stays or gets to go home will open their hearts and let my daughter come home. I wish to thank all of you for every thing you have said. Our Federal Laws are so messed up, there are so many in our Federal Prisons, and they are not changing a thing. Jody |

It seems there has been more than adaquate time served for the crime committed. It is a pity that the judicial system is so unjust.

This concerns my daughter Billie Marie Taylor #03453-078. She's in Tallahassee, Fl. Federal prison. She was put in prison on a first offence for thirty two and one half years. I don't know why so long when there are others out here which have done a lot more than she ever did. Billie Marie has never given any trouble the whole time she has been there. She has gone back to school and even taken courses in Heat and Air. I know they keep her working in Tallahassee all the time on their heat and air units. Billie has lost out on her son and daughters lives. They grew up not knowing there mother or knowing the person she is. She has one son and one daughter. They are grown now and have children of their own. I do very much believe that Billie Marie has done all the time she should and needs to be home with her family. I know as her mother I need her. I need to be able to see and touch my daughter. I know that at my age I'm not a whole lot longer for this world. My one wish is that I am able to see my daughter out from behind all that wire and bars. She needs to be with her family. She needs to be able to see her grandchildren grow up. Marie is not the same person she was when she first went to prison. Over the years she has changed. What it is she grew up in prison. May the Lord be with you and help you do the right thing. Thank You, |

I myself have been convicted on the conspiracy law along with other family members and friends. Three people made statements against me saying they bought drugs from me and that was all it took. I was in a state prison surrounded by a wire fence on the dates and times people said they bought from me. Conspiracy is automatic 20 years. I thought and my family thought I could beat this charge due to the fact of being in prison on the dates mentioned. Oh no in the federal courts it is stated on our case that a jury is not to concern them self with the exact date and time of mentioned drug dealing. My mother is Carol Armstrong who is also in the Tallahassee Federal Prison. My Mother was sentenced 30 years. My Father dead 2 years ago in the Kentucky Federal Prison...My Brother was also incarcerated in the federal prison system in Terre Haute. All on hear say. They never found drugs on him, my father, or me. My State probation office was very upset and knew I had not been dealing any drugs. A girl was mad at my brother because he did not want to be with her anymore and made false statements against him. |
